Commissioning in 2 steps
Upon receipt of a 50% deposit, I will start working on the painting. Upon delivery of the painting by the promise date, you may purchase the finished painting by paying the remaining 50% of the price or you may decline the painting and make no payment beyond the original deposit. The remainder of this page gives examples of the kinds of terms that can enter a proposal. Just as the individual uses and subjects of commissioned images vary, specific proposals will vary from each other and from this example.
Agreeing to a commission
After discussion, I will formalize in writing a proposal including
- Conceptual sketch or photograph
- Medium, size, including known longevity
- Aesthetic intent, specifying composition and technique
- Known third-party intellectual property concerns
- Client's comments, requirements, and intellectual property statements
- Price and sales tax
- Promise date and description of delivery
The proposal shall provide the client a unique electronic link to PayPal to pay a deposit of 50% the full price and NJ sales tax. Payment is also accepted in cash and personal check.
When I provide the written proposal and the client pays the 50% deposit, we both agree to the following terms.
- I shall paint the subject according to the proposal. Major modifications in technique and style might be offered occasionally to the client if I think the painting would be improved.
Delivery and refunds
- After the client and I agree to the proposal, and up to and including the promise date, the client may make either of the following permanent, mutually exclusive decisions.
- The client may decline in writing to purchase the finished painting. The 50% deposit shall not be refunded.
- The client may purchase the painting at any stage and date by paying the remaining 50% of the price. In addition to the original painting, the client will be acknowledged in writing for commissioning the painting alongside all written credit for the illustrator.
- If the painting is ready for delivery by the promise date, I retain copyright in the painting. If additionally, the client has not communicated written intent to decline or accept the painting by the promise date, I reserve discretion to interpret the client's choice.
- If I have not delivered the painting by the promise date, then the client may demand either of the following permanent, mutually exclusive remedies.
- The client may refuse the painting and demand an immediate, full refund for the deposit.
- Upon delivery of the painting, the client may accept the painting with no payment beyond the original deposit.
